3plains LLC maintains this web site as a convenience to our customers. By accessing, browsing and/or using this web site, you acknowledge that you have read, understood, and agree to be bound by the following terms of use and to comply with all applicable laws and regulations. If you do not agree to these terms, you should not review information or obtain goods or products from this site.
Use of Software and Data Developed by 3plains
As a customer of 3plains LLC, you own the website "HTML code" that was developed and billed to you by 3plains LLC. The database raw data (i.e. ASCII text) is owned by the customer, but does not include database files (i.e. Microsoft Access, Microsoft SQL, mySQL), database structure (i.e. Microsoft Access tables, Microsoft SQL/mySQL tables) or ColdFusion code developed by 3plains.
If the customer decides to cancel or terminate their services, 3plains LLC will export and provide text files for the customer as well as original photos. 3plains is not required to export html files or website directories for the customer upon termination. If a customer wants the html files or website structure in tact to take their business elsewhere, 3plains will do so and give a estimated hourly timeframe for the project. This fee will be paid in advance to 3plains.
Any software or code downloaded by you from this web site, including, without limitation, any files, images incorporated in or generated by the software, code and data accompanying the software (collectively, the "Software") is licensed to you under terms of 3plains LLC's standard license agreement or the specific Terms of Use (whether supplied by 3plains LLC or a third party) applicable to any of the Materials (the "License Agreement"). Your rights to use the Software are expressly limited to the terms set forth in the License Agreement or Terms of Use. Access to or downloading of the Software does not in any way transfer title to the Software, or any intellectual property rights contained therein, to you.
Billing Policy
3plains LLC offers monthly and annual billing cycle options. This is determined upon agreement between the customer and 3plains LLC. You may change your billing policy at anytime. All hosting accounts that are billed monthly and will be invoiced at the beginning of month. Accounts become overdue 30 days after the date of invoice "due date". Should your account become overdue, you will receive a 10% penalty fee on the following bill. When accounts are more than 60 days past due, your account will be temporarily shut down and will be unaccessible until payment is made. Credit cards can be taken over the phone and is the best way to ensure prompt payment.
Domain Registration
3plains LLC will register the Client's domain name, make the Client the Registrant and will serve as the administrative contact for the domain registration. Client is solely responsible for selecting the domain name and insuring that the domain name does not infringe on any third party's trademark rights. Client will indemnify 3plains LLC and hold him harmless from any and all claims made against 3plains LLC by any third party relating to any action taken by 3plains LLC on behalf of Client, including reasonable attorneys fees to defend any such claim. The domain name 3plains LLC registers IS OWNED by the registrant and NOT OWNED by 3plains LLC. 3plains LLC only manages the domain name in 3plains's account as a managed service to make it easier on the Client.
Accurate Information
3plains LLC makes reasonable efforts to include accurate and up-to-date information on this website. 3plains LLC makes no warranties or representations as to its accuracy. 3plains LLC assumes no liability or responsibility for any typographical or other errors or omissions in the content on this site. In the event that a service is listed at an incorrect price or with other incorrect information due to a typographical or other error, 3plains LLC shall have the right to refuse or cancel service if listed incorrectly.

Some linked sites are not under the control of 3plains LLC.
Search Engine Results
Search engine results are beyond the control of 3plains LLC. 3plains LLC is moderately aggressive in it's search engine optimization (SEO) techniques ensuring a high success rate after your website becomes established in the 6-12 month timeframe.
Revisions
3plains LLC may at any time revise these Terms and Conditions by updating this posting. You are bound by any such revisions and should therefore periodically visit this page to review the current Terms and Conditions to which you are bound.
Governing Law
The parties agree that this contract will be governed by Minnesota law and any legal proceeding regarding this contract will be brought exclusively in a court of competent jurisdiction in Minnesota.
