This software license agreement entitles the licensee (developer) to install the purchased code (developer code) on a single server or multiple servers for unlimited use thereupon. The "developer code" is licensed to the "developer" and may not transfer to another "developer". Licensee may not redistribute code in any form or modified code in any form. Licensee may modify code for any reason as long as code is not redistributed.

Any use of the database and software contained in the 3plains LLC zip file is on an "AS IS" basis. 3plains LL (THE "LICENSOR") EXPRESSLY DISCLAIMS ALL WARRANTIES, WRITTEN OR ORAL, EXPRESS OR IMPLIED, INCLUDING WITHOUT LIMITATION, WARRANTIES OF MERCHANTABILITY OR WARRANTIES OF FITNESS FOR A PARTICULAR PURPOSE. THE LICENSOR SHALL NOT BE LIABLE FOR LOSS OF PROFITS, LOSS OF USE, OR INCIDENTAL, CONSEQUENTIAL, OR SPECIAL DAMAGES THAT RESULT FROM USE OF THIS DATA AND SOFTWARE, EVEN IF MADE EXPRESSLY AWARE OF THE POSSIBILITY THEREOF. THE LIABILITY OF THE LICENSOR SHALL NEVER EXCEED THE DOLLAR AMOUNT THAT THE LICENSEE PAID TO THE LICENSOR FOR THE USE OF THE DATA AND SOFTWARE DURING THE 12 MONTHS PRIOR TO THE DATE OF A CLAIM. Any rights not expressly granted in this license are reserved to the Licensor, and the Licensor may enforce such rights on its own behalf.
